Legal terms and conditions

1.Our Contract with You

1.1. These Terms and Conditions govern the supply of Product sold by the Premiership DVD Collection Limited a company incorporated in England and Wales with company registration numbers 6530888 and having its registered office at 5th Floor, 71 Kingsway London WC2 B6ST ("We"). To the customer ("You") and constitute the entire and only agreement between us in relation to the Product on this website.

1.2.All orders placed are subject to acceptance by delivery of the goods being either an individual DVD or series of DVDs ("Product") to you at which point a legally binding contract is constituted between us. The processing of payment and acknowledgement of your order does not constitute legal acceptance of your order.

2.Price and Payment

2.1.The price payable for the Product you order is as set out on the website at the time you place your order plus any charges for delivery and insurance as set out on the order form. We are not obligated to accept your order for Product and we may decline to supply in our absolute discretion.

2.2.It is a requirement that we receive payment for the whole of the price of the Product you order and any applicable charges for delivery before your order can be processed. By accepting these Terms you acknowledge that the Product will not necessarily be supplied to you in full immediately and that in the case of the Premiership DVD Collection Product ("Series Supply") you will be sent, on our receipt of payment a container as depicted on the website (or such variation to that container as we shall in our absolute discretion determine) of a size sufficient to hold 10 DVDs. We will then supply to you a DVD containing four matches played by your chosen club which DVD will be dispatched within 14 working days following the conclusion of the fourth matched played. We will further supply to you another eight DVDs in tranches of four matches to each DVD within 14 working days after the conclusion of each fourth match played by your club and the final DVD will be dispatched within 14 working days following the last match played in the season by your chosen club. Whilst every endeavour will be taken to supply the entire set for the price you will have paid we reserve the right to withhold any part of the DVDs if during the course of the Premiership football season the cost of postage for the Product to you increases by more than 5% in which event we may request that you supply a further payment to us to represent the increased cost of postage.

2.3.The price for the Product including delivery and insurance shall be paid only by the methods provided on the website.

3.Delivery and Title

Risk in the Product shall pass to you on delivery and is the case of Series Supply on delivery of each DVD in the Series. Title to the Product shall not pass to you until you have paid the price for the Product in full and there are no other sums whatsoever due to us from you.

4.Cancellation and Returns

4.1.You may cancel your order by giving us notice of cancellation within 14 days commencing with the date you receive the Product. In the case of Series Supply your right to cancel ends on 14th day counting commencing with the date of receipt by you of the first DVD in the set.

4.2.On cancellation for whatever reason you must return the Product to us including display boxes and outer cases at your cost. Notice of cancellation by you must be in writing and either sent by post addressed to us at 11 Tavistock Industrial Estate, Twyford, Berkshire RG 10 9NQ, UK or click here to email us or faxed to us on fax number 0118 934 1335. In any event the notice of cancellation must be received by us within the 14 day cancellation period referred to above.

4.3.If you are returning Product because the same is faulty we will refund the cost of postage to you.

4.4.In the event you are returning a DVD supplied as part of a Series Supply because of a fault with one DVD you are not required to return any other part of the set or the container or the packaging. Whilst every care is taken to ensure that you are supplied with the Product you have ordered sometimes errors occur and you may be supplied with the incorrect Product. In that event please return it to us with a written note explaining what is wrong and we will refund your postage and supply the correct Product or we may ask you to retain the Product at no cost to yourself and we will ship the correct Product to you. In the unlikely event of the supply of wrong Product please telephone to us on telephone number 0870 11 88 030.

5.Rights and Copyright

All Product displayed on this website or referred to in any of our advertising material is the subject of Copyright. You are not authorised to rent out, broadcast, copy or in anyway duplicate any of the Product or any part of it and you are restricted from using the Product or any part of it for public performance. Should you attempt to do so this will constitute an infringement of the Copyright and will render you liable to proceedings at law. The Product is supplied strictly on the basis that it is for your individual personal and non commercial use and you are not permitted to copy, back up or in any other way duplicate the Product or any part of it or amend or adapt the same in any way. The law of Copyright applies equally to the images on the packaging and any copying of those images or part of them will amount to a breach of Copyright if you do so without having obtained, in advance, the Copyright owners written permission.

6. Export of Product outside of the European Union

6.1.If You are a customer providing a delivery address to us for Product which address is outside of the European Union you hereby authorise us at your cost to issue all relevant certificates required for the export of Product on your behalf and you warrant that there is nothing in your country’s sovereign law which forbids the import of Product.

6.2.Our price to you does not include any import levies, duties or taxes of any kind and you will be liable in addition to the price to discharge those charges direct to your own customs or similar officials direct.

7.Format

Unless otherwise specified in our advertising material or elsewhere on the website that Product is supplied in special format, all Product is supplied as region 0 (zero). Unless otherwise specified no Product is supplied in any format of higher resolution.

8.Warranty

We warrant that Product shall meet its description and DVDs delivered to you

8.1.Will be free from defects in materials and workmanship at the time of delivery. Except as expressly provided in these terms and conditions we expressly exclude any further representations, warranties, conditions or other terms whatsoever.

9.Liability

9.1. We refer to the matters set out above. If Product at the time of delivery to you is defective or if Product does not meet the description then we shall replace it (or such part of it as may be faulty) free of charge to you or, in our absolute discretion refund to you the price for the Product or a part of that price.

9.2.We shall not be liable to you in connection with the supply or non supply of Product (except in the case of non supply to refund the price) in any way whatsoever whether direct or indirect or whether in respect of loss of enjoyment or amenity and whether in contract or tort or howsoever otherwise.

9.3.To the extent that we may be liable to you in connection with this contract then our liability will not exceed the value of Product you have ordered however nothing in these terms and conditions shall be deemed to limit our liability to you for death or personal injury caused by our negligence.

9.4.We shall not be liable to you howsoever for any delay or failure to supply.

9.5.If you do not receive Product within 45 days of making payment to us (or in the case of Product supplied as part of Series Supply within 30 days after the conclusion of each 4th match played) you are required to notify us by any of the methods prescribed above to confirm the failure of receipt. Should you fail to notify us within the relevant period we shall not be liable to supply any replacement Product or to refund the Price or any part of it.

10. Unenforceability

If any part of the terms and conditions is unenforceable; the enforceability of the remaining terms and conditions will not be affected.

11.Governing Law

The contract between us shall be governed by and interpreted in accordance with the laws of England and Wales and the English Courts shall have exclusive jurisdiction.

12.Data Protection Act

You hereby consent for the purpose of the Data Protection Act to your details being supplied by us to Boulevard Entertainment Limited a company registered in England and Wales with company number 04522877 and whose registered office is at 5th Floor, 71 Kingsway, London WC2B 6ST who stands as our guarantor to you to meet our obligations to supply to you. The supply of your personal details will not be used by Boulevard Entertainment Limited for any purpose other than to meet claims by you in the event that the same can be proved and in the event that we are unable to do so.

13.Entire Agreement

These terms and conditions set out the whole of our agreement relating to the Supply of Product and cannot be varied. By placing an order with us you acknowledge that you have not relied on any statement, representation, assurance or other warranty (whether made negligently or innocently) other than those expressly set out in these terms and conditions but nothing in this clause shall limit or exclude liability for fraud.
